Chairman FREEMAN: Good morning. Thank you very much for the coming in today. I would first like to put your attention to the report that Judge Stephen Friot, district court judge, had entered a memorandum to the prosecutor who is currently in charge. This judge had been serving in a reserve role under the nomination of President Bush. He was appointed by the president. He was confirmed by the Senate. He was sworn in, and when he was sworn in, he wasn’t designated as a military reservist. You see, his assignment has now been elevated to full military status.

Now, this was a result of a policy adopted by the Bush administration. It was the policy of the Bush administration to reject the U.S. Army’s recommendation and to ignore Judge Friot’s assignment that he was to serve in a reserve status while he was reviewing the cases of 9/11 detainees at Guantanamo Bay. That is the current policy of the Bush administration.

Well, Congress had adopted resolution 1107, which passed both houses, dealing with the issue of detainers, and this is the section that I would like to emphasize to you: «the President shall not hold any person covered by this section without charges and trial unless waived by an appropriate federal court in accordance with article 13(b)(2) of the Constitution.» The detainees at Guantanamo Bay were picked up in Afghanistan. They were the Taliban who had invaded Afghanistan in the post-9/11 time frame, or at least those who were captured by the Americans.

They were transported to Guantanamo Bay, the holding facility at the Guantanamo Bay Naval Base. They were held during that time at the Guantanamo Bay Naval Base. They were there for 9/11 detainees.
