The second ground on which the demurrer was based was that the defendants, William F. Almy, Lillian W. Almy, Frank S. Wood, and George R. The plaintiff asked for an extension of the contract, which was granted, in which event Wood would have an option for two years thereafter. The equipment was delivered by Wood at the time the contract was made, or shortly thereafter, and for a period of some months the plaintiff made payments under the contract, receiving a statement of costs and expenses. He also made a formal and formal statement, certified by a county tax collector, of his distributive share of the income of the Alveoro Mines Company for the taxable year 1931. The plaintiff paid the tax and duly filed the statement, which was received by the State Board of Equalization for the 1931 tax. When the plaintiff took back the equipment he made demand upon the Alcimento Mines Company to pay him for it. The defendant Wood denied that there was any contract with plaintiff for the sale of the equipment and cross-complained for the balance due him under the terms of the contract of January 30, 1930, for coal that had been delivered and for the value of the equipment which had not been returned, for which recovery was given in the judgment.
